General Terms and Conditions
1: APPLICATION
1.1 These General Terms and Conditions apply to all offers, reservations and agreements relating to all accommodation and other facilities rented by Sandy Meurs, Landhotel Flora & Fauna or its affiliates ("Landhotel Flora & Fauna").
1.2 The terms "tenant" and "you" in these General Terms and Conditions mean: the person who has entered into an agreement with Landhotel Flora & Fauna for the rental/use of accommodation and/or other facilities. The term "user" (hereinafter also referred to as "guest") means: the tenant and the persons (who will) use the accommodation and/or other facilities rented by the tenant.
1.3 These General Terms and Conditions apply regardless of your (previous) reference to any own terms and conditions or to other General Terms and Conditions. Landhotel Flora & Fauna objects to all terms and conditions to which you refer or which you are manually used.
1.4 Agreements deviating from these terms and conditions are only valid if they are agreed in writing.
2: RESERVATIONS
2.1 Landhotel Flora & Fauna only accepts reservations from people who are 18 years or older. Reservations from younger people are therefore not valid.
2.2 Landhotel Flora & Fauna reserves the right to refuse different reservations, especially from groups, or to set special conditions without giving reasons.
2.3 If Landhotel Flora & Fauna processes your reservation, Landhotel Flora & Fauna will send you a confirmation, including an invoice, within 14 days of the reservation. You must check this for accuracy immediately upon receipt. Any inaccuracies must be reported to Landhotel Flora & Fauna immediately.
2.4 If you do not receive a confirmation/invoice within 14 days of the reservation, you must contact Landhotel Flora & Fauna immediately, otherwise you will not be entitled to the reservation.
2.5 A contract is concluded between you and Landhotel Flora & Fauna when Landhotel Flora & Fauna has confirmed the reservation to you.
2.6 The contract concerns the rental of accommodation and/or other facilities for leisure use, which is short-term in nature.
3: CHANGES TO THE AGREEMENT
3.1 If you wish to make changes to the contract after the contract has been concluded, Landhotel Flora & Fauna is not obliged to accept them. It is at Landhotel Flora & Fauna's discretion whether and to what extent it accepts these changes. In the event that Landhotel Flora & Fauna accepts your changes, Landhotel Flora & Fauna will charge you a change fee if these changes are requested 28 days or less before the start of your stay.
3.2 Changes to the arrival date and/or location from 28 days before arrival are not permitted. In these cases, the cancellation costs according to Article 14 of these General Terms and Conditions apply.
3.3 If you wish to reduce the number of accommodations after concluding a contract for more than one accommodation, the cancellation conditions apply as described in Article 14 of our General Terms and Conditions.
3.4 If Landhotel Flora & Fauna has to change a reservation you have booked in terms of location, period of stay or type due to other circumstances (e.g. due to an owner booking), Landhotel Flora & Fauna can offer you a suitable alternative.
4: CHANGE
4.1 The tenant and other users are not permitted to transfer the use of the accommodation under any name and for any reason to anyone other than those named in the contract, unless otherwise agreed in writing with Landhotel Flora & Fauna.
4.2 If you and the Landhotel Flora & Fauna have agreed that you and/or one or more users will be replaced, you remain jointly and severally liable to the Landhotel Flora & Fauna alongside the tenant and/or the users replacing you and/or other users for the payment of the remaining part of the rent, the change costs (see Art. 3.1) and any additional costs due to the exchange as well as any cancellation costs.
5: PRICES
5.1 You owe the Landhotel Flora & Fauna the agreed rental price as shown in the reservation confirmation and invoice.
5.2 Discounts and/or special offers can no longer be claimed once the reservation confirmation/invoice has been sent by the Landhotel Flora & Fauna.
5.3 All prices include VAT unless otherwise stated.
5.4 The Landhotel Flora & Fauna is entitled to price increases as a result of interim adjustments to legal regulations or provisions (in particular
6: ADDITIONAL COSTS
6.1 In addition to the rental price, you/the tenant also owe administration costs, bed linen costs and tourist tax. In the event of cancellation after 14 days of the reservation or within 30 days before the start of your stay, the full administration costs remain due and are part of the total costs to be charged in the event of cancellation in accordance with Art. 14.1.
6.2 The tourist tax contribution is set by the responsible municipality at the location of the park. You/the tenant Landhotel Flora & Fauna is always charged with the applicable tourist tax of the respective municipality.
7: PAYMENTS
7.1 A deposit of 50% of the total amount to be paid must be paid within 14 days of the reservation. For reservations within 8 weeks before the start of the stay, 50% must be paid.
7.2 The remaining amount of the rent must be paid at the Landhotel Flora & Fauna on the day of arrival at the latest.
7.3 For reservations made within 30 days of the start of your stay, the total amount to be paid must be paid immediately upon reservation. If payment is not made in accordance with the above, the Landhotel Flora & Fauna may refuse you use of the accommodation and/or other facilities. If it later turns out that you have given a payment order but the amount has not yet been credited to the Landhotel Flora & Fauna bank account upon arrival, the overpaid amount will be refunded retrospectively.
7.4 If you pay the amounts invoiced to you late, you will be in default immediately after the payment deadline has expired. If payment is not made (on time), the Landhotel Flora & Fauna is entitled to terminate (cancel) the contract. You are liable for all damage that Landhotel Flora & Fauna suffers or will suffer as a result, including all costs that Landhotel Flora & Fauna had to incur in connection with your reservation and the cancellation. Cancellation costs are in any case to be charged to Landhotel Flora & Fauna per accommodation. In this case, the provisions of Article 14 apply.
7.5 Landhotel Flora & Fauna is entitled at any time to set off claims against you, for whatever reason, against the amounts you have paid, for whatever reason.
8: ARRIVAL AND DEPARTURE
8.1 The rented accommodation can be occupied from 3 p.m. on the agreed arrival day stated on the booking confirmation. On the agreed departure day stated on the booking confirmation, the accommodation must be vacated by 10.30 a.m.
8.2 If you wish to continue the agreement with Landhotel Flora & Fauna for longer than the agreed period and Landhotel Flora & Fauna agrees to this in writing, Landhotel Flora & Fauna is entitled to nominate another accommodation at any time.
8.3 If the use of the accommodation and/or other facilities is terminated before the agreed time and date stated in the booking confirmation, the tenant is not entitled to a refund of the rental price and/or costs from Landhotel Flora & Fauna (in part). If you have taken out travel insurance and meet the conditions set by the insurance company, you can make a claim for compensation for early termination of your stay directly to the insurance company.
9: RULES
9.1 In accordance with local regulations, all guests are required to identify themselves upon request at "check-in".
9.2 Each accommodation may only be occupied by the maximum number of people stated on the Landhotel Flora & Fauna website for the respective accommodation.
9.3 Landhotel Flora & Fauna reserves the right to make changes to the facilities and opening hours of the facilities, including their partial or total closure, without you being entitled to any compensation.
9.4 In the event of violations of the rules set out in these General Terms and Conditions and/or non-compliance with the instructions of the staff, Landhotel Flora & Fauna has the right to immediately remove you, the tenant and any other user without refunding the rental price or part thereof.
9.5 If the management has serious suspicions that the tenant of an accommodation is violating the law and/or public order and/or morality, the management is authorized to gain access to the accommodation.
10: PETS
10.1 Depending on the accommodation, a maximum of two or three pets belonging to the tenant or user are allowed at Landhotel Flora & Fauna. If you and/or other users wish to bring pets, you must state this immediately when making the reservation. In this case, Landhotel Flora & Fauna will charge you a surcharge, which you must pay. Landhotel Flora & Fauna reserves the right to refuse pets (without giving reasons).
10.2 Pets must be kept on a leash outside the accommodation. Local instructions must be followed. The pets must not bother other guests.
10.3 Dogs must bring a dog basket and flea protection is mandatory for dogs/cats brought along, whereby drops, tablets and a flea collar are sufficient.
10.4 Animals in cages can be brought along free of charge, provided this is stated when booking.
10.5 Visitors' pets are not allowed.
10.6 For transport of animals to countries within the EU, they must be in possession of a European passport. The animals must be vaccinated against rabies and identification by means of a chip or tattoo is mandatory. You are responsible for ensuring that you have the correct travel documents required for your destination.
11: USE OF ACCOMMODATION; INVENTORY
11.1 The tenant/user and the persons accompanying him are jointly and severally liable for the proper conduct in and around the rental property or elsewhere on the property and for the use of the property and the facilities located therein.
11.2 In addition, the tenant/user and his accompanying persons are always jointly and severally liable for damage caused by breakage and/or loss and/or damage to inventory and/or accommodation. Any damage must be reported to Landhotel Flora & Fauna immediately by the tenant and replaced immediately on site, unless the tenant can prove that the damage was not caused by him, other users or one of his fellow travellers.
12: INTERNET USE
12.1 Landhotel Flora & Fauna offers tenants/users and their companions access to the Internet via a WiFi network or cable.
12.2 The tenant is responsible for the proper use of the Internet and for the necessary hardware and software, configuration, peripheral devices and connections as well as measures to secure the computer or operating system.
12.3 Landhotel Flora & Fauna is not liable for damage resulting from the use of the Internet or as a result of network outages.
12.4 When using the Internet, the tenant/user and his/her companions must behave as is expected of a responsible and careful Internet user, observe the legal regulations and refrain from behavior that may harass other Internet users or cause damage to the Landhotel Flora & Fauna in the broadest sense of the word. The tenant/user and his/her companions are obliged to refrain from visiting websites that are illegal or incompatible with the reputation of the Landhotel Flora & Fauna as an accommodation provider.
12.5 If harassment by third parties and/or (other) Internet abuse by the tenant/user or his/her companions is discovered or suspected, the Landhotel Flora & Fauna has the right to block access to the Internet without further notice or not.
12 .6 The tenant indemnifies the Landhotel Flora & Fauna against any claims for damages made by third parties that these third parties may assert (or wish to assert) against the Landhotel Flora & Fauna in any way, insofar as this liability is based on the use of the Internet by the tenant/user and the tenant's companions.
13: DEPOSIT
13.1 The Landhotel Flora & Fauna may require you to pay a deposit at the start of your stay. The deposit may not exceed the total
amount of your booking per accommodation. If the circumstances justify it (e.g. for groups), the Landhotel Flora & Fauna may increase the deposit required.
13.2 The deposit serves to cover damages and/or costs - in the broadest sense of the word - that may be incurred by the Landhotel Flora & Fauna in the event of non-fulfilment of the obligations of the tenant/user and his companions.
13.3 If the deposit is not paid immediately, Landhotel Flora & Fauna is entitled to refuse the tenant and/or other users access to and use of the accommodation.
13.4 If you are in default with the payment of the deposit, Landhotel Flora & Fauna is also entitled to dissolve (terminate) the agreement with immediate effect.
13.5 The deposit or any remaining amount will be refunded to Landhotel Flora & Fauna after the claims (damage to inventory/accommodation and/or other costs) have been settled.
14: CANCELLATION CHARGES
14.1 Within 14 days of making the reservation, the reservation can be cancelled free of charge, unless the cancellation is made 30 days or less before the start of your stay.
14.2 If a reservation is cancelled after 14 days of making the reservation or within 30 days before the start of the stay, both the cancellation costs and the administration costs charged for the reservation will be due. The total costs are 50% of the total amount if cancelled up to 30 days before the arrival date and the full amount if cancelled from the 30th day before arrival or later.
14.3 You can protect yourself against the risk of cancellation by taking out travel cancellation insurance at the same time as making your reservation.
14.4 If you have not arrived within 24 hours of the agreed date without further notice, this will be considered a cancellation. In this case, you will owe the full total amount.
15: FORCE MAJEURE AND CHANGE
15.1 In the event that Landhotel Flora & Fauna makes it impossible to fulfil the contract in whole or in part, temporarily or permanently, due to force majeure, Landhotel Flora & Fauna can submit a proposal for change (different accommodation/different period, etc.) within 14 days of becoming aware of the impossibility of fulfilling the contract. The suspension of the fulfillment of obligations by Landhotel Flora & Fauna is permitted if circumstances arise that are beyond the control of Landhotel Flora & Fauna. Landhotel Flora & Fauna is under no circumstances obliged to compensate for any damage or costs.
15.2 Force majeure on the part of Landhotel Flora & Fauna exists if Landhotel Flora & Fauna is prevented from fulfilling the contract in whole or in part, temporarily or otherwise, due to circumstances that are beyond the control of Landhotel Flora & Fauna, including the threat of war, staff strikes, blockades, fire, floods and other disruptions or events.
16: TERMINATION
16.1 The Landhotel Flora & Fauna is entitled to terminate the contract with immediate effect at any time if personal data provided by you and/or other users is incomplete and/or incorrect when booking. In such a case, no refund of the rent or part thereof will be made.
17: LIABILITY
17.1 The Landhotel Flora & Fauna accepts no liability for theft, loss or damage to or to property or persons of any kind during or as a result of a stay in one of our accommodations and/or other facilities of the Landhotel Flora & Fauna, unless there is intent or gross negligence on the part of the Landhotel Flora & Fauna or (one of its) employees.
17.2 The Landhotel Flora & Fauna is not liable for service disruptions or defects in the services of third parties.
17.3 You/the tenant and each user are jointly and severally liable for all losses and/or damages to the rented accommodation and/or other property of Landhotel Flora & Fauna that occur during its use by you and/or other users, regardless of whether they are the result of actions or omissions by you and/or third parties who are staying in the accommodation with your permission.
17.4 You/the tenant indemnify Landhotel Flora & Fauna against all claims for damages by third parties that are due to actions or omissions by you, other users, your fellow travelers or third parties who are staying in the accommodation with your permission.
17.5 In the event of improper use or improper leaving of the accommodation, in particular excessive dirt, additional costs will be charged, which you must then pay immediately.
18: COMPLAINTS
18.1 Despite the care and efforts of Landhotel Flora & Fauna, you may feel that you have a legitimate complaint about your stay. You should first report this complaint on site and directly to the management. If the complaint is not handled to your satisfaction, you have 1 month after departure from your stay to submit the complaint in writing to: Landhotel Flora & Fauna - Sandy Meurs. The complaint will then be handled with the utmost care. If this does not lead to a satisfactory solution, you have up to 3 months after leaving the hotel to have the complaint dealt with by an appropriate arbitration body or to submit the complaint to the competent court. The decision of this body has binding recommendatory force.
19: APPLICABLE LAW
19.1 The contract between you and Landhotel Flora & Fauna is exclusively governed by German law.
20: TRAVEL DOCUMENTS
20.1 You are responsible for carrying the valid travel documents required for your travel destination. Landhotel Flora & Fauna accepts no liability for the consequences of not having the correct travel documents.
21: DATA PROTECTION
21.1 All data that you provide to us is stored in a file. The data file is used for our guest management. This data may also be used to provide targeted information and offers about our and related products and services, both by us and by third parties. This includes information and special offers. In order to match your interests as much as possible, we may combine your data with data known to other companies. A detailed description of how we process your data can be found on our website under the heading "Data protection".
21.2 At your request, we will correct, supplement, delete or protect your data if, for example, the data is factually incorrect. This may mean that you can no longer use (part of) our services. You have the right to request information from us as to whether personal data concerning you are being processed.

22: GENERAL
22.1 Landhotel Flora & Fauna will send its correspondence digitally unless this proves impossible.
22.2 Obvious printing and typesetting errors do not bind Landhotel Flora & Fauna.
22.3 These General Terms and Conditions replace all previous publications of General Terms and Conditions.
